              Županijski sud u Karlovcu, Stalna služba u Gospiću, kao drugostupanjski sud, po sutkinji toga suda Milki Vraneš, kao sucu pojedincu, u ovršnom predmetu predlagatelja osiguranja C. o. d.d., Z., OIB: , po Odvjetničkom društvu H. i partneri d.o.o. Z., protiv protivnice osiguranja T. M. iz B., OIB: , zastupane po odvjetnicima iz OD Č. & M. d.o.o. u Z., radi osiguranja prisilnim zasnivanjem založnog prava na nekretnini protivnice osiguranja, odlučujući o žalbi protivnice osiguranja izjavljenoj protiv rješenja o osiguranju Općinskog suda u Bjelovaru, Stalne službe u Daruvaru poslovni broj Ovr-1757/2023-2 od 24. kolovoza 2023., 21. rujna 2023.

I. Odbija se žalba protivnice osiguranja kao neosnovana, potvrđuje se rješenje Općinskog suda u Bjelovaru, Stalne službe u Daruvaru poslovni broj Ovr-1757/2023-2 od 24. kolovoza 2023.

II. Odbija se zahtjev protivnice osiguranja za naknadu žalbenog troška, kao neosnovan.

III. Odbija se zahtjev predlagatelja osiguranja za naknadu troška odgovora na žalbu, kao neosnovan.

 

Obrazloženje

1. Pobijanim rješenjem određeno je osiguranje novčane tražbine prisilnim zasnivanjem založnog prava na nekretninama protivnice osiguranja na temelju izvršnog i pravomoćnog rješenja o ovrsi od 3. listopada 2012. poslovni broj Ovrv-4547/12, a koje je postalo pravomoćno i ovršno 25. listopada 2012. radi osiguranja novčane tražbine predlagatelja osiguranja C. o. d.d., Z., OIB: u iznosu od 2.115,29 eura / 15.937,67 kuna, zajedno sa zakonskim zateznim kamatama koje teku od 31. siječnja 2012. pa do isplate po stopi određenoj člankom 29. stavak 2. Zakona o obveznim odnosima, koja se do 31. srpnja 2015. određuje uvećanjem eskontne stope HNB-a koja je vrijedila zadnjeg dana polugodišta koje je prethodilo tekućem polugodištu za 5 postotnih poena, a od 1. kolovoza 2015. za svako polugodište, uvećanjem prosječne kamatne stope na stanja kredita odobrenih na razdoblje dulje od godine dana nefinancijskim trgovačkim društvima izračunate za referentno razdoblje koje prethodi tekućem polugodištu za 3 postotna poena, a od 1. siječnja 2023. po stopi koja se određuje za svako polugodište, uvećanjem kamatne stope koju je Europska središnja banka primijenila na svoje posljednje glavne operacije refinanciranja koje je obavila prije prvog kalendarskog dana tekućeg polugodišta za tri postotnih poena, pa do namirenja predlagatelja osiguranja, kao i daljnjih troškova ovog postupka određeno je osiguranje uknjižbom založnog prava na nekretnini protivnika osiguranja T. M. iz B., OIB: , upisan u zemljišne knjige Općinskog suda u Bjelovar, Zemljišnoknjižni odjel Bjelovar, k. o. B. S. i to: - zk. ul. 1104, kčbr. 548, u naravi Ulica oranica površine

1400 m2, kč.br. 555 u naravi Ulica površine 6948, od čega voćnjak 2741 m2, livada 4207 m2, sveukupno 8348 m2 u omjeru 1/1 vlasnički dio, - zk. ul. 1146, kč.br. 551 u naravi Ul. površine 1671m2 od čega dvorište 1085 m2, kuća, Ulice , B., 171 m2, dvorišna zgrada, Ulica 347 m2, dvorišna zgrada, Ulica 68 m2, sveukupne površine 1671 m2 u omjeru ¼ suvlasničnog djela, - zk. ul. 1159 kč.br. 505 u naravi G. P., oranica, površine 9500 m2, kč.br. 556 u naravi G. P., oranica površine 4279 m2, u omjeru 2/4 suvlasničkog djela, - zk. ul. 1105 kč.br. 550 u naravi Ulica , Oranica, površine 634 m2, u omjeru vlasništva 1/1, uknjižbom založnog prava te naznakom ovršivost tražbine radi čijeg osiguranja je određena uknjižba, a uknjižba založnog prava i zabilježba ovršivosti tražbine imaju takav učinak da se ovrha na tim nekretninama može provesti i prema trećoj osobi koja je te nekretnine kasnije stekla. Istim rješenjem naloženo je protivnici osiguranja da predlagatelju osiguranja naknadi trošak postupka u iznosu od 282,65 eura/2.129,63 kune u roku od 8 dana.

 

              2. Protiv navedenog rješenja u pravovremenom roku žali se protivnica osiguranja zbog žalbenih razloga iz članka 50. stavak 1. točka 7. i 11. Ovršnog zakona. U žalbi predlaže da drugostupanjski sud usvoji njenu žalbu, pobijano rješenje ukine i obustavi predmetni postupak. Potražuje trošak sastava žalbe u ukupnom iznosu od 378,86 eura/2.854,52 kuna.

3. Na žalbu protivnice osiguranja odgovorio je predlagatelj osiguranja koji osporava osnovanost žalbenih navoda protivnice osiguranja, te predlaže da se njena žalba odbije kao neosnovana i potvrdi pobijano prvostupanjsko rješenje. Potražuje trošak odgovora na žalbu u ukupnom iznosu od 282,63 eura/1.129,48 kuna.

4. Žalba protivnice osiguranja nije osnovana.

5. U ovoj ovršnoj stvari prvostupanjski sud je donio rješenje o osiguranju temeljem prijedloga predlagatelja osiguranja koji se zasniva na temelju ovršne isprave – ovršnog i pravomoćnog rješenja o ovrsi od 3. listopada 2012. poslovni broj Ovrv-4547/12, a koje je postalo pravomoćno i ovršno 25. listopada 2012., prema kojemu protivnica osiguranja duguje predlagatelju osiguranja iznos od 2.115,29 eura/15.937,67 kuna, zajedno sa pripadajućim zakonskim zateznim kamatama, a sve temeljem računa pobliže označenih u prijedlogu predlagatelja.

6. Ispitujući prvostupanjsko rješenje i postupak koji mu je prethodio ovaj sud utvrđuje da nisu počinjene bitne povrede odredaba parničnog postupka iz članka 354. stavak 2. točka 2., 4., 8., 9., 13. i 14. Zakona o parničnom postupku (Narodne novine broj 53/91, 91/92, 112/99, 88/01, 117/03, 88/05, 2/07, 84/08, 96/0, 123/08, 57/11, 148/11 – pročišćeni tekst, 25/13, 28/13, 89/14, 70/19 i 80/22, dalje: ZPP), u svezi članka 21. stavak 1. Ovršnog zakona (Narodne novine broj 112/12, 25/13, 93/14, 55/16, 73/17, 131/20 i 114/22, dalje: OZ-a) na koje ovaj sud pazi po službenoj dužnosti.

7. Prema odredbi članka 21. stavak 1. OZ-a u ovršnom postupku i postupku osiguranja na odgovarajući se način primjenjuju odredbe Zakona o parničnom postupku, ako tim ili drugim Zakonom nije drugačije određeno.

8. Donošenjem rješenja o osiguranju prvostupanjski sud je pravilno postupio u smislu odredbi članka 295. i članka 296. OZ-a, prema kojima na osnovi ovršne isprave kojom je utvrđena novčana tražbina predlagatelj osiguranja ima pravo tražiti osiguranje te tražbine zasnivanjem založnog prava na nekretnini protivnika osiguranja.

9. Protivnica osiguranja neosnovano u svojim navodima ističe da predlagatelj osiguranja nije dokazao aktivnu legitimaciju temeljem čega je predložio osiguranje založnim pravom na nekretnini protivnice osiguranja navodeći da predlagatelj osiguranja nije ovlašten tražiti osiguranje na njenoj nekretnini temeljem članka 50. stavak 7. OZ-a, te ujedno ističe zastaru potraživanja.

10. Ovi žalbeni navodi nisu osnovani budući iz podataka u spisu proizlazi:

-  da je između protivnice osiguranja i V. d.d., sklopljen Ugovor o kreditu broj 219507 od dana 29. kolovoza 2008. na iznos 3.000,00 eura zajedno sa zakonskim zateznim kamatama, koji je potvrđen po javnom bilježnika S. M. iz B.,

- da je isplatom iznosa od 2.115,29 eura 30. siječnja 2012. C. o. stekla svojstvo vjerovnika temeljem ovjerene Izjava o ustupu prava, kojom je V. d.d. 7. veljače 2012. prenijela na predlagatelja osiguranja (ovrhovoditelja) svoju tražbinu i sva prava iz Ugovora o kreditu broj: 219507,

- da je u odnosu na navedeno ovrhovoditelj 2012. podnio prijedlog za ovrhu na temelju vjerodostojne isprave Ugovor o kreditu pod brojem 219507 općenito na imovini ovršenika, temeljem čega je javni bilježnik B. J. donio rješenje o ovrsi Ovrv-4547/12, koje je steklo status pravomoćnosti i ovršnosti dana 25. listopada 2012.,

- da je ovrhovoditelj radi regresne naplate 2012. poslao zahtjev za aktivaciju prisilne naplate na FINA-u rješenje o ovrsi Ovr-4547/12, koja je zavedena u redoslijed naplate, te je ovrhovoditelj 2014. i 2016. slao zahtjeve za zavođenje iste

osnove u redoslijed naplate, te je time prekinut tijek zastare odnosu na Ovr-4547/12.

- da je ovrhovoditelj podnio prijedlog za osnivanje založnog prava na nekretnini ovršenice 19. srpnja 2023., temeljem Ugovora o kreditu, a nakon čega je sud donio rješenje od dana 24. kolovoza 2023., kojim usvaja prijedlog osnivanja prisilnog založnog prava na nekretnini ovršenice.

11. Dakle, suprotno žalbenim navodima protivnice osiguranja kojim osporava aktivnu legitimaciju predlagatelja potrebno je istaknuti da je prijedlog za osnivanjem založnog prava na nekretnini zatražen temeljem rješenja o ovrsi poslovni broj Ovr-4547/12, pravomoćnog i ovršnog 25. listopada 2012. donesenog od strane javnog bilježnika B. J., a iz kojeg je razvidno da je ovrhovoditelj upravo C. o. d.d..

12. Nadalje, sukladno odredbi članka 296. OZ-a predlagatelj osiguranja ima pravo tražiti osiguranje novčane tražbine zasnivanjem založnog prava na nekretnini protivnika osiguranja na temelju ovršne isprave kojom je utvrđena novčana tražbina predlagatelja osiguranja, koje založno pravo se, prema odredbi članka 297. OZ-a, na nekretnini upisanoj u zemljišnoj knjizi zasniva uknjižbom, a pri uknjižbi založnog prava u zemljišnoj knjizi se naznačuje ovršivost tražbine radi osiguranja zbog kojeg je uknjižba određena.

13. Obzirom da je tražbina po osnovi temeljem koje se traži predmetno osiguranje tražbine ovršiva, stoga je i odluka o donošenju rješenja o osiguranju tražbine pravilna i utemeljena na zakonu.

14. U odnosu na žalbene navode protivnice osiguranja u kojima ističe da je tražbina u zastari, potrebno je odgovoriti da sukladno odredbi članka 233. stavak 1. Zakona o obveznim odnosima (Narodne novine broj 35/05, 41/08, 125/11, 78/15 i 29/18, 126/21, 114/22 i 156/22 - dalje: ZOO) sve tražbine koje su utvrđene pravomoćnom sudskom odlukom ili odlukom drugog nadležnog tijela, javne vlasti ili nagodbom pred sudom ili drugim nadležnim tijelom, odnosno javnobilježničkim aktom, zastarijevaju za deset godina, pa i one za koje zakon inače predviđa kraći rok zastare. 

15. Međutim, u ovom konkretnom slučaju protivnica osiguranja očito nije imala u vidu pravila o prekidu zastare određena odredbom članka 241. stavak 1. ZOO-a, a prema kojoj odredbi se zastara prekida podnošenjem tužbe i svakom drugom vjerovnikovom radnjom poduzetom protiv dužnika pred sudom ili drugim nadležnim tijelom radi utvrđivanja, osiguranja ili ostvarenja tražbine.

16. Nadalje, odredbom članka 245. stavak 3. ZOO-a propisano je da kad je prekid zastare nastao podnošenjem tužbe ili pozivanjem na zaštitu, ili isticanjem prijeboja tražbine u sporu, odnosno prijavljivanjem tražbine u nekom drugom postupku zastara počinje teći iznova od dana kad je spor okončan ili završen na neki drugi način.

17. Dakle, iz svega prethodno navedenog sasvim jasno proizlazi da je predlagatelj osiguranja podnio prijedlog za zasnivanje založnog prava na nekretnini, a na temelju kojeg je sud donio pobijano rješenje 12. srpnja 2023., te da u konkretnom slučaju postoji kontinuitet prekida zastare.

18. Prema tome, budući se prekid zastare odnosi na određenu tražbinu, a što znači da u konkretnoj situaciji postoji kontinuitet prekida zastare i to podnošenjem zahtjeva za reaktivaciju osnove Ovr-4547/12, 2014. i 2016. godinu, a koji prekid u odnosu na tražbinu koja je predmet ovoga postupka traje i dalje.

19. Stoga žalbeni navodi protivnice osiguranja ničim nisu doveli u pitanje pravilnost i zakonitost pobijanog prvostupanjskog rješenja.

20. Slijedom iznijetog, primjenom odredbe članka 380. točka 2. ZPP-a, u vezi s člankom 21. stavak 1. OZ-a, odbijena je žalba protivnice osiguranja kao neosnovana i potvrđeno prvostupanjsko rješenje o osiguranju.

21. Protivnici osiguranja nije dosuđen trošak sastava žalbe, jer nije uspjela sa žalbom, te joj ni ne pripada pravo na taj trošak (članak 166. stavak 1. ZPP-a, u svezi članka 21. stavak 1. OZ-a).

 

22. Predlagatelju osiguranja nije dosuđen trošak odgovora na žalbu jer isti nije bio potreban ni nužan u ovom postupku (članak 155. ZPP-a, u svezi članka 21. stavak 1. OZ-a).
